Alabama’s Proposed Bill Aims to Strengthen Penalties for Illegal Gambling

In Alabama, a new bill aimed at toughening penalties for illegal gambling operations has been pre-filed for the upcoming 2025 legislative session. This legislative move follows growing concerns about unregulated gambling activities across the state.

New Penalties Proposed

Alabama Representative Matthew Hammett introduced the bill, emphasizing its focus on illegal gambling operations rather than those sanctioned under constitutional amendments. He clarified, “We’re not going after these people that’s operating under a constitutional amendment, like dog or horse tracks. That’s not the purpose of this bill. It’s strictly for these illegal operations outside of the CA’s.”

If approved, the legislation would elevate the charge for operating illegal gambling from a Class A misdemeanor to a Class C felony. This change would significantly impact individuals charged with “possession of electronic gambling machines and other offenses.”

Moreover, the proposed bill outlines increased fines, raising the maximum penalty from $6,000 to $15,000. For repeat offenders, the consequences could escalate further. A second offense could result in a Class B felony, which may carry prison sentences ranging from two to 20 years, alongside a hefty $30,000 fine.

Hammett believes that the current penalties fail to deter illegal gambling and only encourage repeat offenses. He advocates for these changes as a necessary step to address the ongoing issue of unregulated gambling in Alabama.
