Brazil Court Keeps The Door Open In Aviator Fight

Spribe tried to stop Aviator Studio Brazil from operating during the case, but the São Paulo Court of Appeals declined to step in on an emergency basis. Judges said there was not enough proof of immediate harm and also pointed to unresolved questions around who really controls rights tied to the Aviator brand. That leaves Aviator Studio Brazil free to keep working with partners, including Foggo Entertainment, while the main case continues.

A key issue now sits around licensing. The Brazil court signaled that the agreement between Aviator LLC and Aviator Studio Brazil needs fuller examination before any harder conclusion can be reached. In other words, the court chose caution over speed.

The broader legal picture is messy. In Georgia, courts backed Aviator LLC in a major trademark and copyright case and found bad faith registration by Spribe, though Flutter said in 2024 that it would appeal that ruling. In the UK, however, Spribe won an interim injunction in 2025 blocking Aviator LLC from launching a competing product ahead of trial. That split across markets helps explain why the Brazil court avoided a rushed ruling.

For now, Brazil has not handed either side a final win on the brand itself. What it has done is keep Aviator Studio Brazil in the market while judges sort through competing claims over trademarks, licensing, and prior rulings from other jurisdictions.
