Accusations of unfair contractual clauses and mishandling of user data have prompted government action, threatening the company with hefty fines exceeding $1 million.

Unfair Contracts and Privacy Concerns

The heart of the matter lies in Worldcoin’s contractual agreements, deemed by Buenos Aires authorities as prejudicial to consumer rights. Terms such as the unilateral suspension of services without recourse for users and the imposition of offshore regulations, notably from the Cayman Islands, have raised red flags. Moreover, the arbitration clause favoring California jurisdiction over Argentine law further compounds the dispute.

Ariel Aguilar, the Undersecretary of Commercial Development and Investment Promotion of Buenos Aires, voiced the province’s apprehension, citing the opacity surrounding Worldcoin’s operations. Aguilar lamented the complexity of the contracts, coupled with the lack of transparency, hindering a comprehensive understanding of the system’s intricacies.

Privacy concerns intensify as reports surface regarding the storage of user iris data in Brazil, a revelation likely to exacerbate anxieties surrounding data security. Moreover, the absence of explicit prohibitions against minors’ participation in Worldcoin’s ecosystem raises alarms about potential exploitation of vulnerable demographics. This issue resonates with similar apprehensions raised by Spanish authorities, who temporarily suspended Worldcoin operations over similar concerns.
