Worldcoin’s Biometric Project Under Scrutiny in Spain

Well-known for its efforts in biometric identification, Worldcoin is currently involved in a legal dispute in Spain. The Spanish Audiencia Nacional has maintained the injunctions on Worldcoin’s data collection and iris scanning operations among Spanish individuals, following the guidelines of the AEPD (Spanish Data Protection Agency).

The AEPD’s position has been reinforced by recent court cases, which highlight the need to stop Worldcoin’s biometric data processing. Citing potential privacy violations, the tribunal expressed worry over the absence of explicit agreement from residents.

The tribunal’s ruling was the result of Worldcoin’s appeal against the interim prohibition put in place by Spanish authorities, which raised concerns about the gathering of biometric data from minors and the lack of procedures for withdrawing consent.

Upholding Data Privacy Rights

In justifying its ruling, the tribunal underscored the importance of prioritizing the collective interest in safeguarding personal data rights over Worldcoin’s economic pursuits. Despite Worldcoin’s argument invoking GDPR jurisdictional limitations, the tribunal affirmed the AEPD’s competence to enforce regulatory measures pending a final resolution.

Although this decision takes care of the urgent concerns about data privacy, it avoids the more general jurisdictional issues brought up by Worldcoin, giving rise to more legal discussions.
