Seminole Tribe Faces Deadline for Response in Florida Gaming Compact Battle

As the legal dispute over the Florida gaming agreement heats up, the Seminole Tribe faces a critical deadline to respond to West Flagler Associates’ request for an en banc hearing. The United States Court of Appeals for the District of Columbia gave the tribe until August 31 to file a reply. The consequences are considerable, with the Seminole Tribe potentially establishing an internet sports betting monopoly in Florida and offering more casino games such as roulette and craps.

The Seminole Tribe’s request for a response is unusual, given the D.C. Circuit court seldom solicits input on petition petitions. Despite the exceptional nature of the request, the chances of an en banc hearing being granted are small, given the court’s recent history of making such judgments.

An en banc hearing would involve all 11 judges on the D.C. Circuit Court and would allow West Flagler to argue that the 2021 Florida Gaming Compact violates the Indian Gaming Regulatory Act (IGRA). West Flagler claims that the compact incorrectly allows the Seminole Tribe to operate internet gambling, including sports betting, off tribe territory.

West Flagler’s legal stance is centered on the interpretation of IGRA, particularly the provision that regulates gaming activities exclusively on “Indian lands.” The plaintiff asserts that IGRA compacts shouldn’t authorize gaming beyond tribal territories. A three-judge panel previously overturned a ruling by U.S. District Court Judge Dabney L. Friedrich, which declared the 2021 Florida gaming compact as IGRA-violative.

The looming decision on the en banc hearing could directly influence the launch of online sports betting by the Seminole Tribe. If the court denies the en banc rehearing by August 31, the official mandate could go into effect by September 7, enabling the tribe to proceed with online sports betting operations. However, the tribe is expected to exercise caution and await the resolution of the en banc hearing before initiating any major moves.
