In a new development the West Flagler Associates has filed a suit with the Florida Supreme Court to stop the Seminole Tribe from expanding its sports betting operations. This transpires soon after the Seminole Tribe declared the reopening of their sports wagering application.
In an application, West Flagler Associates asked the Florida Supreme Court to “immediately suspend the off-reservation sports betting provisions in the Implementing Law that purport to authorize the Tribe to conduct sports betting statewide.” Additionally, the appeal asks that “no sports betting statewide” continue to apply until the ongoing legal matters are settled.
In December, the Seminole Tribe said that live sports betting will once again be available at its casinos. This declaration came after the U.S. Supreme Court decided not to overturn a $2.5 billion agreement between the tribe and the state that allowed sports betting in Florida.
The Seminole Tribe announced the launching of its mobile sports betting app in addition to offering in-person betting. While new clients must sign up for a waiting, current customers may begin making bets right away. This unexpected launch surprised West Flagler Associates.
The Seminole Tribe “exceeded their constitutional authority in enacting legislation expanding casino gambling in this state without a citizen’s approval,” according to a filing by West Flagler Associates. According to the court records, it was widely believed that the allusions to sports betting were related to sports betting that took place in person and was not the focus of the current case.
In the brief, it is also claimed that the Seminole Tribe presented a “fait accompli” on November 7, taking the petitioners and the court by surprise by taking advantage of the attention caused by their announcement on November 1.
It is unclear how the Florida Supreme Court will rule on West Flagler Associates’ motion to halt off-reservation sports betting and the Seminole Tribe’s growth of its gaming operations in the state while the legal dispute plays out.
