Federal Court Gives Green Light to Seminole Tribe’s Sports Betting in Florida

In a decision with the potential to dramatically reshape Florida’s gambling landscape, a federal appeals court has restored an agreement granting the Seminole Tribe of Florida and its Hard Rock casinos exclusive rights to sports betting in the state.

This development could ignite a surge in online gambling in Florida, particularly if the tribe decides to revive its Hard Rock Sportsbook app and contemplate establishing two new casinos in South Florida. Nevertheless, the ruling invites further legal challenges.

John Sowinski, spokesperson for No Casinos, along with Miami business figures and gambling opponents Armando Codina and Norman Braman, expressed their stance, stating, “Today’s decision will not be the final word on this issue.”

The legal dispute involved West Flagler Associates, a former owner of Magic City Casino and current owner of Bonita Springs Poker Room, which contended that the tribal gambling agreement breached federal Indian gaming laws.

Contrarily, the U.S. Court of Appeals upheld that the Indian Gaming Regulatory Act allows Florida’s arrangement with the tribe. However, the court recognized the potential for additional legal disputes at the state level.

Despite this, the Governor’s administration welcomed the reversal of the previous ruling. Jason Mahon, spokesperson for Governor DeSantis, emphasized that they would continue to work with the Seminole Tribe to ensure the success of the “largest gaming compact in U.S. history,” which is projected to generate over $20 billion in revenue for Floridians.

Despite the ruling, Sowinski of No Casinos remains optimistic about future legal challenges and emphasized that the Florida voters would ultimately decide the expansion of gambling in the state.

Meanwhile, the Seminole Tribe is deliberating its next steps. Spokesperson Gary Bitner expressed that the outcome is advantageous for the tribe and all of Indian Country.

Legal experts predict a ripple effect across the country, prompting other Native American tribes to negotiate gaming deals with their respective states. Moreover, they expect further litigation and possibly an appeal to the U.S. Supreme Court due to conflicting rulings on federal tribal gaming laws’ authorization of online gaming.
