Much attention has been focused on the recent decision rendered in the DraftKings Hermalyn litigation by the United States District Court of Massachusetts. In a landmark decision, the court ruled in favor of DraftKings and issued an injunction against Michael Hermalyn, the former employee of DraftKings who is presently the president, vice president, and head of the Fanatics LA office.
An important part of the first accusation was that Hermalyn could not use or disclose proprietary information without the company’s approval, which the court’s decision forbade. Additionally, he is not permitted to remove such data from DraftKings’ location. In addition, Hermalyn is prohibited from encouraging DraftKings staff members to change jobs or companies for a year beginning on February 1, 2024. This is in response to claims that he is staff poaching for Fanatics, his present employer.
During this period, Hermalyn is also prohibited from providing services to competing businesses, including Fanatics, relating to his previous role at DraftKings. Furthermore, he is barred from relocating, tampering with, or deleting media containing confidential information.
DraftKings is required to post a security bond of $150,000 by May 7, 2024, as per the court’s directive.
Hermalyn’s response to the lawsuit characterized it as an ‘unnecessary character assassination,’ while DraftKings faces additional legal challenges, such as a class action lawsuit filed by the Public Health Advocacy Institute in Massachusetts.
In response to the court’s ruling, a DraftKings spokesperson emphasized the significance of holding Hermalyn accountable, stating, “Today’s ruling by the Court is another victory for DraftKings in its effort to hold Mr. Hermalyn accountable for his brazen attempt to clone DraftKings’ successful VIP program by stealing DraftKings’ employees and trade secrets.”
The spokesperson expressed satisfaction with the court’s enforcement of Hermalyn’s non-competition obligations and emphasized the importance of safeguarding DraftKings’ confidential information. They further highlighted the court’s scrutiny of Hermalyn’s credibility, indicating that the evidence revealed his lack of candor and deceptive behavior.
Lastly, the spokesperson noted the court’s denial of Hermalyn’s motion to dismiss or stay the case, affirming DraftKings’ commitment to pursuing legal action to ensure accountability.
