Supreme Court Pauses Florida’s a Move Towards Sports Betting

The U.S. Supreme Court has temporarily blocked the Seminole Tribe of Florida from introducing sports betting across Florida. The reason? An appeals court decision that backed a gambling pact incorporating sports betting is now under the spotlight.

Chief Justice John Roberts recently placed this hold after the U.S. Circuit Court of Appeals for the District of Columbia endorsed the gambling agreement. This pact, struck between the Seminole Tribe and Florida, has sparked controversy since its inception.

West Flagler Associates and Bonita-Fort Myers Corp., two notable companies, are pushing for this hold. Their objective? To challenge the appeals court’s ruling in the Supreme Court. John Roberts stated, “The final phase of the appeals court’s ruling remains in suspension until further notice.”

This development traces back to 2021 when the pari-mutuel companies filed a lawsuit. This was in reaction to Florida’s legislators giving a thumbs up to the gambling agreement. An agreement that had Governor Ron DeSantis and Seminole Tribe of Florida Chairman Marcellus Osceola Jr. at its forefront.

At its core, the compact allows statewide mobile sports betting. All these bets would be overseen by servers located on tribal land. Marcellus Osceola Jr. commented, “Our intention with this agreement was to introduce a system where all electronic bets are solely under the tribe’s jurisdiction.”

However, the pari-mutuels see this differently. They argue that this method skirts around a 2018 amendment which mandates voter approval for casino gambling in Florida.

The U.S. Department of the Interior, overseeing tribal territory gambling, gave the compact the green light. Yet, the lawsuit alleges it contradicts the Indian Gaming Regulatory Act (IGRA). This is due to the fact it endorses gambling beyond tribal territories.

In 2021, Judge Dabney Friedrich opposed the compact, but by June, an appeals court panel overturned this. By September, the entire appeals court chose not to revisit the issue.

The attorneys of the pari-mutuel companies recently approached the Supreme Court. Their focus? To highlight the deeper issues of the case. One attorney stated, “This case holds nationwide importance, especially considering its potential implications on the future of gaming off Indian lands.”
