The Massachusetts Gaming Commission (MGC) has fined PENN Sports Interactive $15,000 after ESPN host Rece Davis used prohibited gambling language during a live segment of College GameDay in 2024. The violation stemmed from Davis describing a betting pick as a “risk-free investment” — a phrase explicitly banned under both state rules and ESPN BET’s marketing guidelines.

Following an adjudicatory hearing in April, the MGC’s Investigation and Enforcement Bureau determined that the phrase breached both state betting law and ESPN BET’s internal content standards. The commission emphasized that such language misleads viewers by implying that betting carries no risk.
“Mr. Davis used the prohibited language ‘risk free investment’ after he referred to a sports wager,” the commission stated in its decision. “As a result of the aforementioned regulatory violations, the Commission hereby fines PSI d/b/a ESPNBet $15,000.”
The penalty was smaller than fines issued in other Massachusetts cases, reflecting the limited scope of the violation. Regulators acknowledged that Davis is not a PENN employee, that the term did not appear in ESPN BET’s app, and that PENN reported the incident voluntarily.
While the MGC recognized that Davis’ intent was humor, it stressed that regulated operators must maintain strict oversight when their brand appears in gambling-related programming. The commission reiterated its expectation that PENN and ESPN BET enforce compliance with Massachusetts betting standards, even in casual or entertainment contexts.
