Missouri Sports Betting Launch Faces Delay After Emergency Rule Rejection

Missouri’s plan to roll out legal sports betting has hit a roadblock. Secretary of State Denny Hoskins rejected the Missouri Gaming Commission’s (MGC) emergency rulemaking request, delaying the expected June 2025 launch. Now, the process must follow the traditional regulatory timeline, pushing the start date to late summer or fall.

Hoskins announced his decision on February 21, explaining that the emergency request, submitted on January 27, failed to meet legal criteria. “The proposed emergency rules were intended to address specific aspects of gaming regulations. However, following a thorough review, it was concluded that the matter does not meet the criteria for emergency rulemaking according to Missouri law,” he told iGB.

Under state law, emergency rulemaking is only permitted when there is an “immediate danger to public health, safety, or welfare” or if the rule is crucial to preserving a compelling governmental interest. Since sports betting regulations do not meet these requirements, they must undergo the full rulemaking process, which includes public input.

Market Launch and Licensing Rules Face Uncertainty

Originally, the MGC aimed for a June 2025 launch, despite Missouri law requiring sports betting to begin by December 1, 2025. With the emergency request denied, the commission confirmed that licensing rules will take effect on August 30, 2025.

“In the absence of emergency rules, our timeline is being pushed back months,” the MGC stated in an email to iGB. “Commission staff will continue working to ensure we meet the constitutionally required start date of sports wagering not later than December 1, 2025.”

Beyond regulatory delays, another potential hurdle has emerged regarding the number of digital betting licenses, or “skins,” that casino operators will receive. Initially, the MGC interpreted the law to grant one digital skin per physical casino location, a decision welcomed by industry players like Caesars Entertainment. This interpretation played a role in easing opposition to sports betting legalization.

However, a report from industry analyst Ryan Butler on February 18 suggested that the Missouri attorney general’s office might be reconsidering its stance. If the state limits skins to one per company rather than per location, it could drastically alter how casino operators enter the online sports betting market.

Since Missouri regulators cannot begin accepting operator applications until final rules are approved, the delay could push the application window close to the start of the 2025 NFL season, which begins on September 4.

Despite the setbacks, the MGC remains within the legal timeline, with the December 1 deadline still in place. Hoskins, who has played a key role in shaping Missouri’s gambling policies, previously proposed bills to legalize both sports betting and video lottery terminals (VLTs), though these efforts failed.

Defending his recent decision, Hoskins stated: “This decision does not impact the ongoing efforts to review and update the state’s gaming policies. The secretary of state’s office will continue to collaborate with stakeholders as it moves forward with the rulemaking procedure.”
