Brazil Set to Launch Federal Sports Betting Marketplace with Online Casino Games

Brazil is preparing to launch a federal sports betting marketplace with provisions for the government oversight of online casino games, which is a noteworthy move. On December 21, during the last meeting of the Chamber of Deputies, law PL3626/23 was validated, marking a significant turning point in the legislative process. President Lula da Silva will now get the law for the federal government to sign.

On December 13, the Senate returned the measure to the Chamber of Deputies, causing problems for the legislative process. Indecisiveness in the Senate resulted from protracted discussions, particularly in relation to online casino games. The measure kept online casino features in spite of resistance from senators from the Liberal Party, receiving approval from a sizable majority of 261 parliamentarians during the voting session.

Together with the opposition, the Evangelical parliamentarians made a failed attempt to strike the online gaming provision. Evangelical MPs have stated that they want to ask President Lula da Silva to approve the maintained plan, which would remove casino procedures.

Taxation and Licensing Framework

The Brazilian Senate’s Economic Affairs Commission’s (CAE) suggested tax and fiscal frameworks are still in place. A 15% tax will apply to player incentives, while a 12% tax will apply to operators that get a license in the federal market. The tourist and sports industries will get 5% and 6.63% of total income, respectively, leaving Social Security with 2%.

Operators can manage up to three brands with a government license that costs BRL 30 million (about €5.5 million) and is valid for five years. A legal guardian must be appointed and a permanent presence in the nation must be established for both international and domestic firms.
