A new fight has opened in Washington over prediction markets and sports betting. Tribal gaming leaders say federal regulators waited too long, and now Congress needs to step in. The debate cuts straight into tribal authority, consumer protection, and who gets to control sports wagering in the United States.

The Indian Gaming Association has formally called on the US Congress to act against sports betting offered through prediction markets. The group warned that regulatory delays now threaten tribal authority and weaken long standing consumer protections tied to legal gaming.
In a public statement, IGA Chairman David Z. Bean argued that sports betting through prediction markets runs against tribal, federal, and state law. He pointed directly to the Indian Gaming Regulatory Act, which gives tribal governments exclusive rights to regulate gaming on Indian lands alongside states and the National Indian Gaming Commission.
“Indian gaming is the economic bloodline for more than 240 Tribal Governments,” Bean said. “Revenue generated from gaming empowers Tribes to build critical infrastructure and provide basic services to reservation residents.”
According to the IGA, tribal governments commit more than $450 million each year to gaming regulation. That effort supports over 6,000 regulators who oversee operations across Indian Country.
Those systems focus on player safety, fraud prevention, and protections against underage and problem gambling. Bean said prediction markets fall short by comparison, even though they now offer sports related contracts that mirror traditional betting products.
The association stressed that tribal gaming did not grow by accident. It developed through decades of negotiated agreements, oversight, and shared enforcement between tribal governments and regulators.
The IGA also aimed criticism at the Commodity Futures Trading Commission. The agency oversees derivatives markets and currently sits at the center of the prediction market debate.
Bean said prediction market platforms have offered sports contracts for nearly a year without firm regulatory intervention. He pointed to a recent CFTC statement that confirmed the agency has not decided whether those contracts involve prohibited activity.
“It is no coincidence that the prediction market corporations selected the smallest and weakest financial regulatory agency to push out their self-certified, self-regulated online gambling platforms,” Bean said.
IGA leaders argued that continued delay only benefits prediction market operators while leaving tribes and consumers exposed.
The association now wants either enforcement or legislation. IGA leaders said the CFTC should apply existing law without delay. If that fails, Congress should amend the Commodity Exchange Act to restate clear limits on gaming activity conducted outside established regulatory systems.
Tribal governments across the country stand united on the issue. The IGA described prediction market sports betting as an illegal expansion that undercuts decades of work tied to tribal gaming integrity.
“Tribes have fought for too long and worked too hard to build and preserve the integrity of our industry and the resources that enable tribal governments to provide for their communities,” Bean said.
The debate has already reached Capitol Hill. Congressman Abe Hamadeh has begun asking questions in Congress about prediction markets and their role in sports betting. His involvement adds political pressure as lawmakers weigh whether regulatory gaps now require a direct legislative response.
