A settlement has been reached between DraftKings and the National Football League Players Association (NFLPA) on a lawsuit pertaining to an NFT contract. Following a dispute over licensing rights and the management of NFTs associated with the name, image, and likeness (NIL) of active NFL players, this conclusion was reached. Background of the Dispute In December 2021, the NFLPA and DraftKings announced an exciting collaboration to launch a gaming NFT initiative. The agreement allowed DraftKings to use the licensing rights of active NFL players, which included their NIL in the games. However, issues arose when DraftKings allegedly threatened to halt the NFT offerings in 2023. This prompted the NFLPA to take legal action. In July 2023, DraftKings made an announcement on its website, stating that it would discontinue its Reignmakers platform and NFT Marketplace. The company cited "recent legal developments" as the main reason for shutting down these services. This move led to the NFLPA filing a lawsuit in August 2024, claiming that DraftKings owed approximately $65 million in damages for breaching the contract. Despite the ongoing legal battle, the NFLPA and DraftKings have now mediated the dispute and reached a non-binding settlement in principle. A joint letter sent to Judge Analisa Torres confirmed that both parties have agreed to a 60-day stay of the case, which is set to extend until March 28, 2025. During this time, the parties will work on finalizing the terms of the settlement agreement. The letter reads: “The parties in the above-captioned action respectfully submit this joint motion for a 60-day stay of this action, until March 28, 2025. The parties have mediated their dispute and reached a non-binding settlement in principle, subject to the mutual execution of a definitive settlement agreement.” As the parties finalize the settlement, it remains to be seen how this resolution will impact future collaborations between sports organizations and NFT platforms.
